We successfully challenged the unlawful implementation of Luton Borough Council's Selective Licensing Scheme which was due to come into force on 1st August 2020. The scheme and the designation have now been revoked.
Under part 3 of the Housing Act 2004, Councils are given powers to bring into force a scheme to licence privately rented property under prescribed conditions. However to do so a Council needs to follow the correct process in consulting with potentially affected parties and ensuring that they follow the statutory framework to bring into force such a scheme.
Many people will be affected by the current COVID-19 pandemic, for many services or goods purchased have not been delivered due to the restriction measures.
Please refer to the specific terms and conditions attached to the provision of services or goods as to what your rights are. You should also consider that the Consumer Rights Act 2015 fortified and simplified the rights of consumers in relation to such contracts.
